This Terms of Service ("Terms") is a legal agreement, which describes the terms and conditions on which KOOFEI LIMITED ("We") grant to an end user ("You" or "User") who accesses to the Fire and Glory (the "Game") or its applications for mobile devices or other applications thereof (collectively, "Services")
Please read the Terms carefully.Please note that by accessing or using our Services, you agree that you have read, understood, and accepted to be bound by the Terms. If you do not agree to the Terms, please promptly exit this page and stop accessing our Services. Please note that we reserve the right, in our sole discretion, modify or revise the Terms at any time, and you agree to be bound by such modifications or revisions hereof.
You must be at least 13 years of age to access and use our Services. If you are at least 13 years of age but below 18 years of age or such other age of majority required for this Agreement to be binding and enforceable against you in your country of residence ("Age of Majority"), your parent or legal guardian must establish an Account with us. Please note that by establishing an Account with us for use by their child/ward or otherwise permitting their child/ward access to our Services through their Account, the parents and legal guardians guarantee the compliance by the child/ward of the obligations under this Agreement.
We do not represent, or warrant that our Services will be compatible with your mobile device or other device/equipment. It is your sole responsibility to ensure that you use compatible mobile device and other device/equipment to access and use our Services. Please note that all fees incurred in accessing our Services (including without limitation data charges) shall be borne by you.
Subject to this Terms, we grant to you a non-exclusive, non-transferable, non-sharable, revocable, limited license to use our Services solely for your personal, non-commercial use to the Services in accordance with this Agreement. You agree to use our Services only for lawful purposes, and in a way that does not infringe the rights of or inhibit anyone else¡¯s use of our services. Please note that we are entitled to immediately terminate this license, without any liability to you in the event of your violation of the Terms.
Our Services comprise of content belonging to us and/or our licensors, which are protected by copyright, trademark, and other intellectual property laws. We hereby reserve all rights, including without limitation, intellectual property rights and other rights, in respect of our Services. You shall not use our Services or the intellectual property comprised in our Services in a manner that infringes our or our licensors¡¯ rights.
When your Account is opened, you may be required to choose a name to identify yourself ("Account ID"). You shall not use as your Account ID a name which violates any third party's trademark right, copyright, or other proprietary right, or which may mislead others to believe you to be an employee of ours, or which we deem in our sole discretion to be offensive. You agree that we reserve the right to change, terminate or suspend access through offensive or inappropriate Account ID in our sole discretion at any time. We also reserve the right, in our sole discretion, to delete or change your character name for certain services that we deem to be inappropriate or offensive at any time. And you are solely liable for all activities conducted through your Account or under your Account ID or character name.
Please note that your account is for your personal use only. You specifically agree not to: (1) share your account credentials with anyone else, (2) sell, offer to sell, rent, lease, trade or otherwise transfer your account to anyone else for any reason, (3) sell, offer to sell, rent, lease, trade or otherwise transfer any ¡°Gold" or other virtual currencies, game resources, in-game services like ¡°speed-ups,¡± or other in-game items associated with your account (collectively, ¡°In-Game Items¡±), except by using mechanisms within the Game that anticipate and specifically allow for the non-commercial transfer of In-Game Items to anyone else for any reason, (4) buy, offer to buy, accept, access or use any other user¡¯s account or In-Game Items, except by using mechanisms within the Game that anticipate and specifically allow for the non-commercial transfer of In-Game Items, and (5) link to or otherwise endorse or identify any websites, organizations, or persons that sell, offer to sell, rent, lease, buy, offer to buy, accept, access, trade or otherwise transfer accounts or In-Game Items. You acknowledge that any purported transfers of Game accounts or In-Game Items in violation of this Terms, including but not limited to transfers in exchange for money or other compensation, are void and breach this Terms, and that we have no responsibility to assist you in connection with completing any such transaction. You agree that we have the right to terminate or suspend your account and/or your right to access or use the Game if we discover or reasonably believe that you have attempted to buy, sell, rent, lease, license, or transfer your Game account or associated In-Game Items, or used or accessed an account or In-Game Items transferred by another user, or linked to or otherwise endorsed or identified any websites, organizations, or persons that attempt to buy, sell, rent, lease, license, or transfer accounts or In-Game Items or conducted any other transactions in violation of this Terms.
You hereby agree to comply with the following rules of conduct/usage when you access to and use the Game: (1) you will comply with your obligations to third party mobile platform providers, including without limitation Apple and Google, from whom you download the Game, including any terms regarding payment for In-App Purchases made through such platforms; (2) you will not attempt to obtain login information or access to another player¡¯s account, collect or harvest personal information from any other users for any purpose; (3)you will not exploit, distribute or publicly inform other users of any game error, miscue or bug which provides for an unintended advantage or allows impersonation of another person, including by use of automated collection mechanisms such as clear graphics interchange formats, cookies, or similar technology for any purpose; (4) you will not exploit differences in pricing for In-App Purchases or In-Game, through arbitrage or in any other manner, by sending altered, deceptive, or false source-identifying information, including but not limited to, by use of a proxy or spoofed IP addresses or VPNs, or by requesting that someone else make In-App Purchases or purchase In-Game Items on your behalf in order to take advantage of a difference in pricing; (5) you will not harass, threaten or bully any other player, nor post or submit any abusive, threatening, bullying, harassing, obscene, defamatory, offensive, pornographic or illegal content, or content that infringes or violates the rights of someone else, or impersonate any other person; (6) you will not use the Game for any unauthorized commercial purpose, including but not limited to commercial advertisement or solicitation (such as chain letters, junk e-mail, ¡°spam¡± or other repetitive messages), or gathering or transferring In-Game Items for sale; (7) you will not use the Game for performing in-game services for payment, such as leveling up or item collection services; (8) you will not use or design cheats, exploits, automation software, bots, hacks, mods or any unauthorized software designed to modify or interfere with the Game experience; (9) you will not remove or obscure any proprietary notices within the Game; (10) you will not to disrupt or attempt to disrupt the Game or any other person¡¯s use or enjoyment of the Game; (11) you will not attempt to gain unauthorized access to the Game, to accounts registered to others, or to networks from which portions of the Game are provided, including by circumventing or bypassing robot exclusion headers or security mechanisms for the Game; (12) you will not use any service or software that accesses, intercepts, "mines," or otherwise collects information from the Game or that is in transit from or to the Game; (13) without our prior written consent, you will not make any automated use of the Game, or take any action that imposes an unreasonable burden on our infrastructure in any manner; (14) without our prior written consent, you will not use any software, technology, or device to send content or messages, scrape, spider, or crawl the Game, or harvest or manipulate data from the Game; (15) you will not improperly use our support services, including by submitting false reports; (16) except where permitted by law or relevant open source licenses, you will not modify, reverse engineer, decompile, disassemble, decipher or otherwise try to derive the source code for the Game; (17) without our prior written consent you will not copy, modify or distribute content from the Game; (18) you will not advocate, promote, encourage, or otherwise facilitate any illegal behavior, including without limitation the use of illegal drugs, unlawful gambling or theft. You agree that your failure to comply with the aforesaid rules of conduct/usage may result in the suspension of your account, or any portion of your account, and/or subject you to any of the penalties we deem to be reasonable or necessary in our sole discretion.
Our Service may provide communication channels such as forums or chat areas ("Communication Channels") designed to enable you to communicate with other Service users. We have no obligation to monitor these communication channels but reserves the right, at our sole discretion, to review information posted to the Communication Channels and to remove any information, at any time, without prior notice, for any reason. We may also terminate or suspend your access to any Communication Channels at any time, without prior notice, for any reason. You agree that all your communications with the Communication Channels are public and thus you have no expectation of privacy regarding your use of the Communication Channels. We are not responsible for information that you choose to share on the Communication Channels, or for the actions of other users.
You agree that your use of the Service shall be lawful and that you will comply with the usage rules. You agree not to use our Service to transmit or otherwise disseminate information that is obscene, indecent, vulgar, sexual or otherwise objectionable or inappropriate. You agree that we have the right, but not the obligation, to remove any information you transmit through the Communication Channels which we deem to be harmful, offensive, or otherwise in violation of this Terms at any time at our sole discretion.
We reserve the right to interrupt the Services from time to time on a regularly scheduled basis or otherwise with or without prior notice in order to perform maintenance. You agree that our Services may be interrupted for unforeseen circumstances or causes beyond our reasonable control, and we cannot guarantee that you will be able to access our Services or your Account whenever you may wish to do so. In any event, we shall not be liable or provide any compensation for any interruption of the Services arising from unforeseen circumstances or causes beyond our reasonable control.
Our Service, the Account and any other game resource of ours is provided to you on an "AS-IS" basis. We provide no warranties or remedies for our Service. You acknowledge that we are not responsible for any damage, loss, liability or result caused by widgets from other developers. We and our suppliers disclaim all express, implied or statutory warranties relating to the Service, including without limitation, merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that use of the Service will be uninterrupted, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.
Neither we nor our suppliers shall be responsible or liable with respect to any subject matter of this Terms or terms or conditions related thereto under any contract, negligence, strict liability or other theory for loss or inaccuracy of data or cost of procurement of substitute goods, services or technology, or for any indirect, incidental or consequential damages including, but not limited to loss of revenues and loss of profits. Our aggregate cumulative liability hereunder shall not exceed the grater of fifty dollars ($50.00) or the amount paid by you for the Service that caused such damage. Notwithstanding the foregoing, the exclusion of certain warranties or the limitation or exclusion of liability may not be permitted by relevant laws in certain instances. Therefore, some of the limitations herein may not apply to you.
These Terms and the licenses granted hereunder are effective on the date you accept this Terms and shall continue unless these Terms is terminated pursuant to this section. We may suspend or terminate your Account and/or access through your Account for an indefinite period of time, terminate your Account and/or access through your Account and/or terminate this Terms immediately and without notice if you breach this Terms or any terms of service or privacy policy of any third party platform such as mobile platforms or if we, in our sole discretion, believe you to have willfully infringed any third party intellectual property rights, or if we are unable to verify or authenticate any information you provide to us, and in such case, you will lose access to the Services including all game resources and we shall not have any obligation to refund any fees you paid or provide any other compensation for unused game resources or otherwise have any other liability whatsoever to you.
This Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China without giving effect to conflict of laws principles, and all disputes, controversies or claims arising out of or in connection with this Agreement, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre ("HKIAC") under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The number of arbitrators shall be three. The place of the arbitration shall be Hong Kong. The language of arbitration shall be English.

If you no longer want KOOFEI LIMITED to make active use of your information, you may send an e-mail to services@fireandglory-app.com. Place "Delete My Account" in the subject line and include your first name, last name, e-mail address and user ID number from which you access our games (if applicable) in the body of the e-mail. We will respond to your request within thirty (30) days. KOOFEI LIMITED may use your information unless and until you send KOOFEI LIMITED such a request. Please note that your information, for example those records pertaining to payments or customer service matters, may be retained for legal and accounting purposes. If you have sent or posted content on the Service, we may not be able to delete it.
